NO more UK Citizenship: What You Need to Know About the New Illegal Entry Guidance By Sobia Shawl, Principal Solicitor, Generis Legal Solicitors, Slough

UK Citizenship Update on Illegal Entrants into the Country.

The landscape of UK immigration law is constantly evolving, and a recent update to the “good character” guidance for citizenship applications has brought significant changes. At Generis Legal Solicitors, we understand these changes can cause concern and confusion, so we’re here to clarify.

As of February 10, 2025, the Home Office has implemented stricter rules regarding citizenship applications from individuals with a history of illegal entry into the UK. If you’ve entered the UK without valid entry clearance, you’ll now face a much higher chance of your citizenship application being refused, regardless of how long ago the illegal entry occurred.

Key Changes:

Increased Scrutiny:

The updated guidance places a strong emphasis on deterring illegal entry, particularly those arriving via “dangerous journeys,” such as small boats or concealed vehicles.
Where in the past, illegal entry in the past 10 years was the main concern, now any illegal entry can be a cause for refusal.

“Good Character” Redefined:

The definition of “good character” has been significantly tightened, with illegal entry now carrying far greater weight.

Mitigating Circumstances:

While the new rules are stringent, there is still the possibility of considering “exceptional, compelling, and mitigating” circumstances. The Home Secretary retains discretion in these cases.

Application Timelines:

It is very important to note that applications submitted before February 10, 2025, will be assessed under the previous guidelines.

What This Means for You:

If you have a history of illegal entry and are considering applying for UK citizenship, it’s crucial to seek expert legal advice. At Generis Legal Solicitors, we can assess your individual circumstances and provide guidance on the best course of action.

We understand that these changes can be unsettling, but we’re committed to providing clear and accurate information. Our team is equipped to navigate the complexities of UK immigration law and help you understand your rights and options.
